Much of the experience and engagements discussed in the Real Estate and Loan Portfolio sections related to distressed assets.

This work has involved assisting clients in evaluating such assets and then enhancing performance, disposing of such assets or in acquiring such assets. We have worked with clients through their own operating challenges (including bankruptcy proceedings). For lenders or acquirers of loans, we have helped them assess the considerations of borrower or asset financial, operating or potential fraud issues. In some cases this has included consideration of formal litigation, bankruptcy or criminal proceedings.

These situations are particularly complex and there are usually many competing interests each of which have various options. In addition, this work usually involves working together with our client and other advisors such as legal counsel to identify and evaluate potential courses of action and rehabilitation possibilities. For example, for real estate properties this may involve consideration of current market conditions, completion of construction, enhanced operational performance and so forth. If in consideration of a lender’s position (whether as the owner of a non-performing asset or as a potential acquirer of such loan) the analysis will involve a full understanding of the lender’s rights through the relevant documentation and past lender and borrower behaviors as well as the condition, considered in its broadest sense, of the subject property and the borrower and its possible courses of action.

We have worked with numerous sellers and buyers of distressed assets including extensive assignments for RTC assisting in their disposition programs, working with buyers of assets from the RTC and for sellers and buyers of distressed loans ranging form individual assets to packages of thousands of loans with face values in the billions of dollars. During their Andersen tenure the principals of Insight were involved in such distressed asset transactions on a worldwide basis, introducing methodologies and evaluative and reporting tools in Europe, South America and Asia.
